A National Emergency was declared in March 2020 in response to the COVID pandemic to provide relief to employee benefit plans, participants and beneficiaries affected by the COVID-19 outbreak. The Outbreak Period was established by the Departments of Labor and Treasury (“agencies”) to provide temporary relief by relaxing rules around timeframes for submitting certain benefit elections and changes (examples include submitting benefit changes due to a Qualifying Life Event and electing COBRA continuation coverage). The timeframes were extended beginning March 1, 2020 until sixty (60) days after the announced end of the National Emergency.
The Department of Labor, the Treasury Department and the IRS have indicated that the National Emergency ended on May 11, 2023, and the Outbreak Period ends July 10, 2023 (60 days after the end of the COVID-19 National Emergency).
As of the last day of the Outbreak Period, the extensions under the emergency relief notices for timeframes that began during the COVID-19 National Emergency no longer apply.
